Full Journal pdf2006-05-09 House Journal Page 3991 HB 365 Representative Coghill moved that the House adopt the Conference Committee with limited powers of free conference report (page 3988), thus adopting: CONFERENCE CS FOR HOUSE BILL NO. 365 "An Act making appropriations for the operating and loan program expenses of state government, for certain programs, and to capitalize funds; making appropriations for state aid to public schools, centralized correspondence study, and transportation of pupils; and providing for an effective date." Representative Coghill placed a call of the House and lifted the call. The question being: "Shall the House adopt the Conference Committee with limited powers of free conference report?" Representative Coghill moved and asked unanimous consent that the roll call on the passage of the bill be considered the roll call on the effective date clause. There being no objection, it was so ordered. The following memorandum, dated May 9, 2006, was received from David Teal, Legislative Fiscal Analyst, Division of Legislative Finance: "Version N of the CCS HB 365(FIN)-the Conference Committee operating budget that will be considered on the floor of both House and Senate today-contains a technical error in section 3. There are two potential courses of corrective action: 1. Produce a corrected version of the bill, explain the problem on the floor, waive the 24-hour rule, and vote on the corrected version. 2. Adopt version N as printed and correct the error in engrossment. Because both House Chief Clerk and Senate Secretary will have the corrected version of the bill, the engrossment process will not be delayed. 2006-05-09 House Journal Page 3993 Option 2 is the more expedient and is the option I recommend. A fiscal note submitted by the Department of Corrections clearly makes a fund source change. The note was adopted by the Conference Committee and shows in section 2 of the bill (as a net zero), but the program that generates the fund roll-up in section 3 suppressed printing because the fiscal note nets zero. The programming error has been fixed. Section 3 makes no appropriations, so is often considered "informational only." Nevertheless, correction of this manifest error would eliminate concerns that the fiscal notes do not match the enacted version of the bill." Pursuant to the memorandum, the following was engrossed: CONFERENCE CS FOR HOUSE BILL NO. 365(Corrected) (same title) The Chief Clerk notified the Senate.
